Under state legislation Work Health and Safety Act 2022 the state government has produce a Code of Practice – Managing the risk of falls at workplaces. This document is a guide to compliance as required to comply with state OHS laws, which is overseen by WorkSafe WA. This document describes the legal requirements which is in addition to the National Construction Code (NCC) or BCA to provide access for maintenance on commercial buildings. The applicable Australian Standards are required to be complied with under the NCC.
Responsibilities
Under the OH&S Act 2022 Industrial Manslaughter Laws apply and it is the responsibilities of the owner of the building who manages or leases the premises to provide access for maintenance.

People Conducting Business or Undertaking- meaning everyone involved with planning or providing roof access has an obligation to provide adequate access under the applicable Codes and Standards
